Terms of Service for the GetMePost application

§ 1. General provisions
- These Terms of Service set out the rules for the electronic provision of services within the GetMePost application available at getmepost.com and app.getmepost.com (the "Application").
- The Application operator is the entity identified in the "Operator details" section on the About page (the "Operator").
- Use of the Application requires acceptance of these Terms and the Privacy Policy.
- The Terms are made available free of charge in a form that allows the user to download, save, and print them.
§ 2. Definitions
- User — a natural person with full legal capacity, a legal entity, or an organizational unit that has registered an Account in the Application.
- Account — the User's data set and workspace within the Application.
- Subscription — a paid service granting access to Application features within a chosen plan and billing period.
- User Content — any materials (texts, documents, links, images) entered into the Application by the User.
- AI Content — materials generated by the Application using artificial intelligence models.
- Third-Party Platforms — social networks (including LinkedIn, X/Twitter, Facebook, Instagram, Threads) to which the Application enables publishing of Content.
§ 3. Type and scope of services
- The Application provides the following services: (a) generation of textual content using AI based on the User's knowledge base and selected topics, (b) publishing and scheduling publication on Third-Party Platforms, (c) collection of publication performance statistics.
- The Operator reserves the right to introduce changes to Application features, including adding new ones and withdrawing existing ones, with a 30-day notice in case of material changes.
§ 4. Technical requirements
- Use of the Application requires a device with internet access, a current web browser with JavaScript and cookies enabled, and an active email account.
- The Operator is not responsible for disruptions in the Application's operation resulting from circumstances beyond the Operator's control (force majeure, infrastructure provider outages, third-party actions).
§ 5. Registration and Account
- Account registration is free of charge and requires an email address and a password.
- The User undertakes to provide truthful data and to keep it up to date.
- The User is responsible for keeping Account credentials confidential. The Operator is not liable for the consequences of credentials being disclosed to third parties.
- One person may hold only one Account, unless the Operator agrees to a different arrangement (e.g. organizational accounts).
§ 6. Subscriptions and payments
- The Application offers a free plan with limited functionality and paid plans (Subscriptions).
- Current pricing and plan scope are available on getmepost.com and within the Application panel.
- Subscriptions renew automatically for the next billing period unless the User cancels them before the renewal date in the Account panel.
- Payments are processed by external payment providers. The Operator does not store full payment card data of Users.
- In case of payment failure, the Operator may suspend access to paid features after prior notice by email.
§ 7. User Content and intellectual property
- The User retains all rights to User Content and to generated AI Content, to the extent permitted by law and by the licenses of AI model providers.
- The User grants the Operator a free, non-exclusive license to process User Content to the extent necessary to provide the services (including knowledge base indexing, AI response generation, publishing to Third-Party Platforms).
- The User represents that they hold all rights to User Content and that uploading it to the Application does not infringe third-party rights.
- It is forbidden to upload to the Application any unlawful content or content infringing third-party rights, in particular: copyrighted content without owner's consent, third-party personal data without legal basis, content containing malware.
§ 8. AI content generation
- AI Content is generated using third-party language models. The Operator does not guarantee the substantive, factual, or stylistic correctness of generated content.
- The User is required to verify AI Content before publication.
- The Operator is not liable for the consequences of publishing AI Content, including any infringement of third-party rights, if the User has failed to verify it.
- Content generation is subject to limits defined in the chosen Subscription plan.
§ 9. Publishing on Third-Party Platforms
- Publishing on Third-Party Platforms requires the User to first connect their account on a given platform with the Application.
- The User undertakes to comply with the terms of service of the Third-Party Platforms.
- The Operator is not liable for the actions of Third-Party Platforms, in particular for the suspension of a User's account, changes in algorithmic reach, or restrictions of API features.
- Outages of integrations with Third-Party Platforms shall not give rise to claims for damages exceeding the Subscription fee paid for the current billing period.
§ 10. Prohibited use
It is forbidden to:
- use the Application in a way that violates the law or good morals;
- generate and publish misleading, discriminatory, defamatory, or hate-inciting content;
- generate content infringing copyrights, trademarks, or other third-party rights;
- scrape data from the Application without the Operator's written consent;
- circumvent the Application's technical safeguards and Subscription limits.
§ 11. Withdrawal from the contract
- A User who is a consumer or a sole trader for whom the contract is not of a professional character has the right to withdraw from a distance contract without giving any reason within 14 days of its conclusion.
- Starting to use AI Content generation features within the withdrawal period constitutes consent to performance of the service before the deadline expires, which results in the loss of the right to withdraw with respect to the part of the service already performed.
- The User submits a withdrawal statement by email to support@getmepost.com.
§ 12. Complaints
- Complaints regarding the operation of the Application can be submitted to support@getmepost.com.
- A complaint should include a description of the issue, Account details, and preferred contact method.
- The Operator processes complaints within 14 days of receipt.
§ 13. Liability
- The Operator's liability towards Users who are not consumers is limited to the amount of Subscription fees paid by the User during the 12 months preceding the event.
- The Operator is not liable for lost profits, data loss, or indirect damages arising from the use of the Application, to the extent permitted by law.
- Liability limitations do not apply to consumers to the extent they would conflict with mandatory provisions of law.
§ 14. Personal data
- The data controller of the User's personal data is the Operator.
- Rules for processing personal data are set out in the Privacy Policy.
§ 15. Termination
- The User may delete their Account at any time from the Application panel or by contacting the Operator.
- The Operator may terminate the contract with a 30-day notice period, and in case of a serious breach of these Terms — with immediate effect.
- After termination, User data is deleted or anonymized in accordance with the Privacy Policy.
§ 16. Changes to the Terms
- The Operator reserves the right to amend these Terms for important reasons (changes in law, changes to Application features, security considerations).
- Changes take effect 14 days after the Users are notified by email and by an in-Application notice.
- A User who does not accept the changes may terminate the contract before they take effect.
§ 17. Out-of-court dispute resolution
- A User who is a consumer may use out-of-court methods of dispute resolution, including the European Commission's ODR platform available at ec.europa.eu/consumers/odr.
§ 18. Final provisions
- The contract is governed by Polish law. This provision does not deprive a consumer of the protection granted to them by mandatory provisions of the law of their country of habitual residence.
- The court competent to resolve disputes with Users who are not consumers is the court having jurisdiction over the Operator's registered office.
- Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Act on Provision of Services by Electronic Means, and the Consumer Rights Act.
